Terms of Service

The agreement between you and Luvarly for using Atroxabot, in plain language. Please read it before you put your first agent to work.

About these terms

Atroxabot is a service for creating AI agents and putting them to work. It is run by Luvarly, a company registered in the Netherlands, and when these terms say we or us, they mean Luvarly. These terms are the agreement between you and us for the Atroxabot website and app, including features we add later unless they come with terms of their own.

By creating an account or using Atroxabot, you accept these terms. Our privacy policy explains how we handle personal data. If you do not agree with these terms, do not use Atroxabot.

Some rules differ for consumers and businesses. You are a consumer if you use Atroxabot for purposes outside your trade, business or profession. If you use Atroxabot for a business, you accept these terms on behalf of that business and confirm that you may do so.

Who can use Atroxabot

You must be at least 18 years old, or the age of majority where you live if that is higher. You may not use Atroxabot where the law forbids it, or if we closed an earlier account of yours for breaking these terms.

Your account

  • Accurate details: use a real email address and keep it up to date. We send account and billing messages to it.
  • Keep it secure: protect your password, and your Google account if you sign in with Google. Tell us at support@atroxabot.com straight away if you think someone else has access.
  • Your login is yours: do not share your login with others or sell your account.
  • Your responsibility: you are responsible for what happens through your account, including everything your agents do.

Your agents and what they do

An agent acts on the instructions you give it, with the model, skills and connectors you assign, in the places you choose: a chat in the Atroxabot app, your messaging apps or a schedule. Whatever it does there, it does on your behalf.

  • Your instructions: you decide what each agent does. You are responsible for its instructions and for what it sends, posts, changes or deletes through your connectors and messaging apps, as if you had done it yourself.
  • Accounts you connect: only connect accounts and services that you own or have permission to use, and give an agent only the access its job needs.
  • Other services' rules: when an agent works in another service, such as a messaging app, you must follow that service's terms and policies. Some services restrict automated accounts or messages.
  • People your agents talk to: if an agent talks to other people, make sure they know they are dealing with an AI where the law requires it. You are responsible for handling their personal data lawfully.
  • Budgets: an agent cannot spend more than the budget you give it, and an agent without a budget can use your whole balance. Setting budgets that suit you, and keeping an eye on what your agents do, is up to you.
  • Check important work: review what an agent produces before you rely on it, and do not let an agent make decisions that seriously affect people without a person checking them.

Acceptable use

You may not use Atroxabot, or set up an agent, to:

  • Break the law or help someone else break it.
  • Create, store or share child sexual abuse material, intimate images of anyone without their consent, or content that promotes terrorism.
  • Harass, threaten, defraud or deceive people, including by pretending to be someone you are not.
  • Send spam or unsolicited bulk messages.
  • Collect or use other people's personal data without a lawful reason, or infringe anyone's privacy or intellectual property.
  • Create malware, attack systems, or get into accounts, systems or data you are not authorized to access.
  • Disrupt or overload Atroxabot, get around its security, credit limits or budgets, or copy, scrape or reverse engineer it, except where the law allows.
  • Resell access to Atroxabot without our written permission.

The providers whose models run your agents have their own rules, and your use must follow them too. For Claude models, that is Anthropic's Usage Policy (opens in a new tab).

To report content or use of Atroxabot that you believe is illegal or breaks these terms, write to support@atroxabot.com. We look into reports and suspected breaches, and may limit what an agent or account can do while we do. If we take action against your account, we tell you why, unless the law forbids it, and you can ask us to reconsider by replying.

AI output and models

Your agents run on AI models from third-party providers. Today that is Anthropic, the maker of Claude, and we may add other providers later. To handle a request, we send the provider what the agent needs: its instructions, the conversation and what it reads through its skills and connectors. The privacy policy explains how that data is handled.

  • Output can be wrong: AI models can produce answers that are inaccurate, incomplete, out of date or made up, and an agent can act on a misunderstanding. Check anything that matters.
  • Not professional advice: do not rely on an agent for medical, legal, financial or other professional advice. Ask a qualified person.
  • Not our views: what an agent writes does not reflect our views and is not an endorsement by us.
  • Unexpected output: despite the providers' safeguards, a model can sometimes produce content that is unexpected or offensive.
  • Models change: providers update and retire models, and we may add, change or remove models. Which models each plan can use is shown on pricing and models.

Your content and ours

You keep the rights you have in what you put into Atroxabot, such as your agents' instructions, your skills and your messages, and in what your agents produce for you, as far as the law allows. AI output can resemble output produced for others, so you may not have exclusive rights in it.

You allow us to store, process and send your content as far as needed to run Atroxabot for you, including sending it to model providers and the services you connect. This permission ends when you delete the content or your account, except for copies the law requires us to keep.

Atroxabot itself, including its software, design, name and logo, belongs to Luvarly or our licensors. We give you a personal, non-exclusive right to use Atroxabot under these terms, and no other rights in it.

Connectors and other services

Connectors and messaging apps link Atroxabot to services run by other companies. Their terms and privacy policies apply between you and them. We do not control those services and are not responsible for them, for how they handle your data or for changes they make. If a service changes or withdraws its access, a connector or messaging channel may stop working.

Plans and credits

Atroxabot has a free plan and paid plans. Each plan includes a number of credits every month and decides how many agents you can have and which models they can use. If you move to a plan with fewer agents, your oldest agents within the new limit keep running and the others pause. The current plans, prices and allowances are on pricing.

  • What credits are: credits are a prepaid allowance for using Atroxabot. Your agents use them for the model work they do, and how many a request uses depends on the model and on how much the agent reads and writes. Our guides explain this in more detail.
  • Monthly refill: your plan's credits refill every month, whether you pay monthly or yearly. Credits from your plan do not carry over to the next month.
  • Top-ups: you can buy extra credits at any time. They go into the same balance as your plan's credits and do not expire while your account is open.
  • When credits run out: your agents pause until your credits refill or you add a top-up. An agent that reaches its own budget pauses until the next month, or until you raise its budget.
  • Changes in usage: we may change how many credits a model uses. We tell you before an increase takes effect.
  • No cash value: credits cannot be exchanged for money, refunded, transferred to another account or sold, unless the law requires otherwise.

Payments, renewal and cancellation

  • Payments: Stripe handles our payments. We do not store your full card details.
  • Prices and tax: we show prices in euros in Europe and in US dollars elsewhere. Prices include VAT where it applies.
  • Renewal: a paid plan renews automatically at the end of each month or year, as you chose at checkout, and we charge the price that applies at that time until you cancel.
  • Cancelling: you can cancel at any time from your account. Your plan stays active until the end of the period you paid for, then ends. We do not refund part of a period you have started, unless the law or these terms say otherwise.
  • Price changes: if we change the price of your plan, we tell you at least 30 days before the new price applies to you, so you can cancel before then.
  • Failed payments: if a payment fails, we may pause your paid plan until it is settled.
  • Refunds and chargebacks: if we refund a payment, or you dispute it with your bank or card issuer, the credits it bought are removed from your balance as far as they are unused. If you dispute a payment for a plan, the plan ends at once. If you think a charge is wrong, please contact us first at support@atroxabot.com: we can usually sort it out faster than your bank.

Your right of withdrawal in the EU

If you are a consumer in the European Union or the European Economic Area, you may withdraw from a purchase within 14 days of buying it, without giving a reason. At checkout we ask you to confirm that you want your plan or credits to start straight away, and that you understand what this means for your right of withdrawal:

  • Plans: you can still withdraw within 14 days of buying a plan. If you do, your plan ends and we refund what you paid, minus an amount in proportion to the service you received until you told us you were withdrawing.
  • Top-ups: the credits are added to your account immediately. Because you ask for this at checkout and confirm that you then lose your right of withdrawal, you cannot withdraw from a top-up once its credits are in your account.
  • Businesses: the right of withdrawal is for consumers. It does not apply to purchases made for a business.
  • How to withdraw: send a clear statement to support@atroxabot.com within the 14 days, saying which purchase you withdraw from. You do not need to use a form. We refund you through your original payment method without undue delay, and within 14 days of receiving your statement.

Closing your account

You can stop using Atroxabot at any time, and close your account yourself in account settings. When your account is closed, your agents stop, unused credits lapse and a paid plan ends at once, without a refund for the rest of its period. To use the period you paid for, cancel your plan first and close your account once it has ended.

We may suspend or close your account, or stop an agent, if you seriously or repeatedly break these terms, if you do not pay, if the law requires it, or if your use puts Atroxabot, other users or other people at risk. Where reasonable, we warn you first and give you a chance to fix the problem. We tell you why, unless the law forbids it.

If we close your account because you seriously broke these terms, unused credits and the rest of your paid period lapse without a refund, unless the law requires one. If we close your account for any other reason, or stop offering Atroxabot, we tell you at least 30 days in advance where we can and refund the unused part of the period you paid for.

Availability and changes to Atroxabot

We work to keep Atroxabot running well, but we cannot promise that it is always available, fast or free of errors. We sometimes need maintenance, and services we rely on, such as model providers, can have outages.

Atroxabot changes over time, and we may add, change or remove features and models. If a change takes away something important from the paid plan you are on, we tell you in advance, and you may cancel and get a refund for the unused part of your period.

Liability

As far as the law allows, Atroxabot is provided as it is and as available. If you are a consumer, you keep your legal rights, including your right to a service that matches what we promised. Nothing in these terms takes away rights that consumer law gives you.

As far as the law allows, we are not liable for:

  • Indirect or consequential loss, such as lost profit, lost revenue, lost data or damage to reputation.
  • What your agents do on your instructions, through your connectors or in other services.
  • Decisions you make based on AI output.
  • Third-party services, including model providers, the services you connect and messaging apps.
  • Loss caused by events outside our reasonable control.

Our total liability to you for all claims together is limited to the amount you paid us in the 12 months before the claim. These limits do not apply to damage caused by our intent or gross negligence, to death or personal injury, or where the law does not allow liability to be limited.

If you use Atroxabot for a business, you compensate us for third-party claims, and the reasonable cost of handling them, that arise from your use of Atroxabot in breach of these terms or the law, including what your agents do.

Governing law and disputes

Dutch law applies to these terms and to your use of Atroxabot. Disputes go to the competent court in the Netherlands.

If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts there.

If something goes wrong, tell us first at support@atroxabot.com. Most problems are solved fastest that way.

Changes to these terms

We may change these terms, for example when Atroxabot or the law changes. We tell you about material changes by email or in the app at least 30 days before they take effect. The date at the top of this page shows when the terms last changed.

If you do not agree with a change, you can cancel your plan and close your account before it takes effect. If the change is to your disadvantage, we refund the unused part of the period you paid for. If you keep using Atroxabot after that date, the new terms apply to you.

General

  • Whole agreement: these terms, the privacy policy and what you agree to at checkout are the whole agreement between you and us about Atroxabot.
  • Separate parts: if a court finds part of these terms invalid, the rest stays in force.
  • No waiver: if we do not enforce a right straight away, we still have it.
  • Transfer: you may not transfer your account or these terms to someone else. We may transfer them to a company that takes over Atroxabot. We tell you if we do, and it does not reduce your rights.
